1. TERMS OF SERVICE
These Terms and Conditions will hereby administer all activities and/or actions listed below. Should any terms be breeched by the user, Anoxs Web Services, henceforth known as "Anoxs", reserves the right to terminate any plan(s) and/or contract(s) it deems detrimental to the well-being of Anoxs and/or its users.
This agreement explains the terms and conditions which are automatically binding upon all deals made with Anoxs, and exists to define the agreement between you, the customer, and Anoxs in order to ensure optimum efficiency and satisfactory service.
By accessing this website, and by purchasing any plans and/or contracts from Anoxs, you accept and are bound to these Terms of Service. Anoxs may update these terms at any given time without notice to you. Please check our terms regularly in order to ensure you are aware of the current Terms.
Acceptable Usage PolicyYou will act responsibly in all areas relating to Anoxs. This includes use of its property, as well as the treatment of not only its Staff, but its other users as well. Failure to comply with this can result in the automatic cancellation of any account on the judgment of any Staff member. The client is given the non-exclusive, non-transferable right to display, access, and utilize any services available to them within the boundaries of these Terms. This right is limited to the decision of Anoxs and its Staff. You must comply with all copyright laws worldwide in your use of Anoxs' services and prevent unauthorized copying of their contents, or access to files. Conversely, the client hereby acknowledges that any prohibited material placed on Anoxs' services by the user may result in the immediate suspension and/or cancellation of the Customer’s account, depending on the severity of the breach of this Agreement and on the judgment of the administration of Anoxs. Any access, storage, transmission, distribution, or display of material which is in violation of any particular law and/or regulation is prohibited.
Examples of prohibited materials, without limitation to, includes:
- Materials which infringe upon any trademark, copyright or other laws protecting materials or data in the absence of a valid right to do so.
- Materials which are slanderous, degrading, obscene, defamatory, or constitutes any item which may be seen as significantly offensive to any individual.
- Unauthorized disclosure of any private information.
- Information which is solely displayed for the key purpose of causing discomfort to an individual and/or group(s).
- Adult-orientated sites, pornography, or any other sex-related material including any items which imply, link to, or infer upon any other sexual content of any kind.
Prohibited is NOT limited to the above list, and subject to the decision of Anoxs Administration
Usage of ResourcesIn order to maintain optimum efficiency as well as service to Anoxs' personnel and clients, each user must restrict himself/herself to the data space and bandwidth allowances as specified upon initial purchase, unless a change is other specified by the Anoxs Administration. Should a client fail to keep within his/her specified allotment of resources, Anoxs reserves to right to suspend and/or terminate the account with prior warning.
Server and/or Network AbuseShould any improper use of Anoxs property and/or material be permitted and/or undertaken, criminal and/or civil liability may be imposed upon the perpetrator. Example of system and network abuses, without limitation to, include:
- Unauthorized access to any data, systems and/or networks, include attempts to probe or breach security or authentication.
- Interference with any user, host, or network in any method which is deemed detrimental by the Anoxs Administration.
- Distribution or hosting of any destructive or harmful content included, but not limited to: Trojan Horses, Worms, and Viruses.
- Any form of attacks upon a system and/or network including, but not limited to, Denial of Service attacks, attempts to overload a system, forgeries of program/script/command/messages of any kind designed to interfere with another system and/or network.
Should any abuse be noted by the Anoxs Administration, whether unintentional or voluntary, Anoxs reserves to right to undergo the immediate cancellation of the client's account. Should abuse occur as a result of a breach in the security of the client's server and the client is to be found in fault by the Anoxs Administration, they hereby accept full responsibility for any abuse which occurs as a result of their actions.
Fees/PaymentIn complying with the plans listed on the webpage, you agree to promptly, and without excuse, pay the services fees as defined by the Anoxs Plans. Failure to do so can result in the suspension of an account until payment, or cancellation of account in the case of an extended lack of payments.
AdvertisementsIn recieving and using any services provided by Anoxs, you agree that you will not remove any advertisements placed by the Anoxs Administration under any circumstances. Such advertisements are in place to raise the funds necessary for the optimum operation of Anoxs resources.
Knowledge and ExpertiseBy establishing an account, you agree that you or your Webmaster have the knowledge necessary to maintain your account on a technical level. Anoxs has no obligation to advise, teach, supply or provide any such knowledge or customer support outside of the scope of the agreed plan.
Advertising & MarketingYou agree that during the term of this Agreement, Anoxs may publicly refer to you, as a customer of Anoxs within the scope of the Privacy Policy. Any information revealed is extremely limited and done so with extreme caution for the welfare of the client.
IndemnificationAll customers shall defend, indemnify, and hold harmless Anoxs and its affiliates, partners and representative/staff against any and all losses, damages, costs, liabilities, and expenses which any of the Indemnitees may suffer, incur or sustain as a result of:
- A breach by the customer of his/her agreement
- Customer's information stored by Anoxs, the customer's webpage, or any page related to the customer as a result of their contract with Anoxs
- Violation by the customer by any of its employees, staff, and/or representatives of Anoxs' agreement and/or any applicable law, rule, regulation, order, by-law, or agreement
- Claims or actions by third-parties which allege misappropriation of trade secrets or intellectual property rights infringement as a result or relating to in any way to the Customer
- Any damage cause to the intellectual property of another individual as a result of or relating to the Customer
The terms of this section shall survive any termination of this Agreement.
LiabilityYou agree that neither Anoxs nor its providers shall be liable for any damage, loss, or expense of any kind arising out of or resulting from your use of the services, materials, content, or information on its sites regardless of whether such liability is based in tort, contract, or otherwise. While Anoxs promises optimum uptime and reliable service, Anoxs is in no way liable for any compensation for any server downtime. In no event shall Anoxs or any of its providers be liable for any direct, indirect, special, incidental, consequential, or punitive damages arising out of or in any way related to the services, materials, content or information provided by Anoxs or any other products, services, or information offered, sold, or displayed on Anoxs’ sites, your use of, or inability to use Anoxs’ services generally, or otherwise in connection with this agreement, regardless of whether Anoxs or any of its providers have been advised of the possibility of such damages.
Compliance with LawYou agree that when using any services provided by Anoxs, you will not conduct any activities unintentionally or voluntarily which will collide with any laws, by-laws, or agreements.
Failure to Comply to AgreementShould Anoxs become aware of any violation or threatened violation to the terms of this Agreement, Anoxs may pursue any remedies including, but not limited to, legal and/or monetary compensation, and denial of services. You agreement Anoxs shall have no liability to you or any of your customers as a result of any action Anoxs may take, including, without limitation, suspension or termination of services. You are expected to cooperate with Anoxs in order to ensure the terms of this Agreement are maintained by both parties.
2. PRIVACY POLICY
Anoxs Web Services, henceforth known as "Anoxs", promises to do everything within their scope in order to ensure all customer's rights to privacy are honored. In order to create and sustain a healthy relationship between Anoxs and our clients, this Privacy Policy has been created in order to protect, and inform you in regards to your privacy rights.
All customer information is handled only by Anoxs Administration and its Representatives for the sole purpose of protecting its clients. For this reason, the Anoxs reserves the right to examine any data stored on its servers if such an act is deemed necessary by the Anoxs Administration. All sensitive information provided to Anoxs is kept under strict secrecy within the Administration so that our clients can appreciate that their information will not be free for public viewing, whether unintentional or done purposely. Only minor information, such as Client names have a possibility of being displayed as "Anoxs Clients" in areas such as testimonies and advertising.
Information SecurityAnoxs will protect client confidentiality to the fullest extent possible. Anoxs will protect the loss, misuse, and alteration of information that is collected from customers, through well-defined electronic and managerial procedures.
Information DisclosureAnoxs will not otherwise disclose client information unless Anoxs Administration finds reason to believe such information is legal and necessary to bring about any legal action, including and not limited to identification, contact, or lawsuits, in order to protect Anoxs and its clients. For this reason, all clients have reason to trust in the judgment of the Administration in all legal matters deferred to Anoxs.
